Sr. Abhaya

Even if justice has not been meted out to Sr. Abhaya after 16 long years of investigation, we in Kerala should be satisfied to note that this case has proved yet again that that two (for the time being) Government agencies are in dire need of termination. We should ask the “lying” media to keep aside their clamor for Sr. Abhaya and instead ask the court to start the relevant procedures to scrap these agencies, that seems to have nothing to show in their achievements over the years they have been in service.

The first one being CBI.

I checked to see how they have gone one about with their recruitment so as to have selected such “incompetent” candidates. This is what I have copied from their official site.

2.1 Executive Ranks :
(i) The Director, Special Directors and Addl. Director are recruited exclusively by
deputation of the officers of Indian Police Services, who have been approved for
appointment as Director General of Police/and Additional Director General of Police
under the Government of India respectively. Recommendations for appointments are
made by a CBI Selection Board headed by Central Vigilance Commissioner and Home
Secretary, Secretary (Co-ordn & PG), Cabinet Secretariat as Members. The views of the
incumbent Director are considered by the Board for making the best choice. Final
selection to these posts of CBI is made by the Appointment Committee of the Cabinet
from the panel recommended by the aforesaid CBI Selection Board. The Director, CBI
shall have a minimum tenure of 2 years regardless of the date of his superannuation.

This also brings another fact to light; the Indian Police Services also needs to be scrapped since they are the ones who have given birth to these candidates.

The next in line should be the Directorate of Forensic Science under which comes the STATE FORENSIC SCIENCE LABORATORIES.

And after all these has been done, the innocent believers can rest in peace; in assurance that the Church (any) cannot be anything else but pure and holy as Jesus Christ himself.

Sister Abhaya

Been too busy at work and more than I miss writing, I miss reading all my favourite blogs but then I have to pen something today....

Can Sister Abahya’s parents have some peace of mind now?

Of course they are the first ones who matters but I think this case matters to many of us too.

If one asks why, there are no specific answers. It is not as though this is the only murder case which has been languishing in the court rooms, but it is a case which tugged the conscience of many. A nun who had taken solemn vows of poverty, chastity, and obedience was murdered and denied justice while the institution that was supposed to have come to her rescue remained passive. But not passive to thwart justice at every juncture of this 16 years long case. And now a nun who took the same solemn vows has been arrested along with her fellow priests. All of them, I understand were heading educational institutions. As for the claims from some quarters that they are innocent surprises many. Those arrested did undergo narco analysis and polygraph tests and the ex-CBI officer did have his doubts on Sister Sephy during his short role in this case. As for CBI arresting only on the grounds of Sanju P. Mathew’s disclosure seems silly, or maybe I am being too hopeful.

Anyway, let us wait for some more dramas since as usual the case has been politicized.

Then as told, it is not the CBI who needs to be applauded but the High Court since the CBI succumbed to pressures all along. And this is way the judiciary needs to act. I pray we see this commitment in every case.

Aravind Adiga rides atop his Tiger

Aravind Adiga’s tiger brought mixed reaction from the Indian populace. Some say this is the true India while some are shocked and feel insulted.

How dare an Indian demean the 'ready to shine in a few years' India thus? Won’t the rest of the world (whom Indians look up to!) have more reasons to continue looking down?

I have not read the book as yet and I don’t look forward to reading it either. With the media beaming out similar stories daily and the rest left to our wildest (yet true?) imaginations, who needs a book to shed light?

Maybe mine is a pessimistic outlook and I should be joining the rest and give Aravind a good bashing on my blog at least! But I shall not.. the tone maybe crude as they say but we Indians need waking up.

Looking at the way most crimes get away and the nexus between criminals (including the police) and the politicians, should we expect anything better just because we haven’t experienced it ourselves?

Look at God’s Own Country when it discovered that the terrorists killed in Kashmir were Malayalees. We are now told (by the media) that they existed since 15 years! Every other day, we hear of mass swindling and the political connections. We wait hopelessly to see at least one behind the bars but the media soon replaces one swindler with another and the show continues. We heard of Human God’s and the amount of wealth they accumulated (source maybe foreign or domestic) but they still continue to reign as Gods. There is one Sister Abhaya still haunting the court premises.

Well… being Diwali I shouldn’t be a spoil sport but my pessimistic mind fell into the trap and here are some articles which can further shed light.

Indian judges must clean up their courts

Justice R. Basant of the Kerala High Court, in his speech to the concluding session of the annual conference of the Kerala Criminal Judicial Staff Association, said, “The judiciary is the last ray of hope for Indians. The failure of the judiciary will have devastating results.”

This observation by Justice Basant carries considerable weight, as he knows, inside and out, the legal and illegal procedures commonly adopted by the courts.

For example, in order to file an application for bail in a criminal case, a person needs to pay a stamp duty of 2 rupees (US 4 cents). But by the time the application reaches the magistrate for a hearing, a client will usually have paid 700 to 1,000 rupees (US$14-$21) in bribes. Most of it is demanded and paid within the registry of the court where the application is filed.

The barking dog...

Read that the CBI team has finally packed up their bags and gone, after spending the tax payer’s money and giving high hopes to those who were looking forward to justice.

Their last bark was to convey the imminent arrest of a priest and a nun after their narco-analysis test. The CBI team reminds me of dogs with their tails between their legs. Isn’t it time this whole rubbish team is scrapped away? If they cannot perform independently but be at the whims and fancies of the government then the public does not need them. At least those hard working CBI officers will not be mocked and made into puppets.

And putting two and two together wasn’t it all staged by the ruling party and the church, just to distract the followers? The spat between them were staged and the public has yet again become donkeys!

Anyway “Vengeance is mine saith the Lord”, so let me hope that justice prevails.

Sister Abhaya

One of my readers prompted me to write this today..

After all the drum beating, this case is dying again. Woe to all those criminals who are behind this. It is a pity that there is only a Joemon Puthepurakal to uphold justice in our country. After Nawab Rajendran, we have one more to follow his footsteps. I think we need more like this if our courts and police are dead.

Sister Abhaya

Thought I shall share this shocking video that was forwarded by my friend.

Well.. I dont know what to say.

When ex-minister P.J. Joseph was accused, I never believed initially, but now I have reasons to believe from close quarters. Those who are close to him says he was taking medicines for depression. Does depression make one behave indecently?

Anyway it is time the whole Christian community irrespective of their denomination work towards bringing to light the murderers of Sister Abhaya. To stop speculations, rumours, and character assasinations and to purge the church, it has become necessary.

I pray that the authorities find the courage to publish the facts without any prejudice or fear since CBI has already submitted their report.

Sister Abhaya

We read that there have been more breakthroughs in this case. The police may soon arrest the culprits. As suspected initially, the priests and the nuns were involved in the murder. Sister Abhaya was killed since she saw something which ought to have never happened in a Convent.

This murder made a lot of impact upon the GOC residents. For me personally, since then, I lost whatever respect that I had for the priests and the nuns. I studied in a Convent School and I have seen the various faces of the nuns. There were good ones and the bad ones. But it was an accepted fact that they had given up a normal life for the work of God. But with this murder, whatever was bottled up against this class among the normal residents broke free. I think it was from this point of time that we heard the Mimicry artists mimicking the priests and making fun of them.

I am not saying that an act of a few has made the whole Clergy community bad but it has made a difference. After all, no one forced them to give up anything to do God’s work. It was their choice and they knew what they were giving up. This is similar to the sexual abuses which came to light and is now the cause for many law suits.

May God bring the murderers to light and may this be a lesson to all who profess to have given up everything to do God’s work. Let those who hid the murderers behind their cloaks remember that nothing can be hidden from the Almighty.

Sister Abhaya - Finally

Finally a break through they say: after 15 long years..

Narco findings

Narco analysis tests were conducted on Sister Seffy and sister Sherly, nuns and batchmates of Abhaya and two priests - father Jose Puthrukayil, who taught Malayalam at St Pius convent and father Thomas Kottoor, a psychology professor and Diocesan of the Knanaya Catholic Church.

A former police official VV Augustine, who investigated the murder and closed it as a case of suicide, also underwent a brain mapping earlier.
Sources said that these tests, which were conducted last week at the Forensic Science Laboratory in Bangalore, have helped the CBI team achieve a certain breakthrough.

The findings are that the members of the clergy as well as the police official were in the know of the murder. Sources add that the tests revealed that one priest was present at the murder site and the other was in the know, but not present.

Cracking down

Sources also indicated that the CBI will either make arrests or bring the case up for hearing before Onam or within the next two weeks.

For the first time, Sister Abhaya’s father also seemed optimistic about justice being served. “I feel this time, the CBI will succeed in nailing the culprits We are living on the hope that the case will finally be solved and those behind the murder are identified,” said Thomas Mathai, father of the deceased nun.

-------------------------------------------

The tainted CBI can now relax a bit.. but there are still more unsolved cases to be solved and they should act irrespective of Community or political pressures.

Sister Abhaya

Sister Abhaya has become synonymous with injustice. This young lady is still creating terror in hearts of those who erred. She was murdered in Year 1992 and even after many attempts by CBI (India’s Central Bureau of Investigation) the case remains unsolved. But now there is renewed hope for her parents and for the whole state itself with the disturbing find that her original chemical examination report was tampered with. The local police and CBI were pressured during their investigations and all the evidence were destroyed except for this report. It is frightening to realize that power enough to shut the mouths of an entire state exists. The clergy did nothing to help the case and hence the fingers clearly points to them. As per Abhaya’s father, the same day he requested the Senior sister to bring in a sniffer dog and to take finger prints, but this was brushed away. And later the photos and other evidence were destroyed. Although the CBI came to the conclusion that it was a murder they opted not to investigate further, which is even more extra ordinary. Mr. Thomas who headed the CBI was forced to resign even when he had 7 years of service left since his conscious did not permit him to continue.
Will the murderers be brought to justice?
